Should I Hire an Attorney for my Social Security Disability Case?
Yes...and...No.
Hire an experienced Social Security disability attorney if you just started your claim and you are not usually an organized person. If you procrastinate completing tasks, or you are intimidated by the process, then an attorney may be necessary. But remember, an attorney at the beginning of the process can do little more than help you complete reports, birddog medical records, and basically stand in line with you. If you are looking for some amount of magic pixie dust to be sprinkled over your claim and get it magically approved, you have way too high expectations.
But, I would also hire an attorney from the very beginning if you know you're going to have a tough case and you want your attorney to be familiar with it to sufficiently represent you at your hearing. An attorney who has handled your case personally from the beginning to the end will be a better advocate on your behalf.
Now, you also need to hire an attorney if you have been denied and your case is scheduled for a hearing. However, once you know you are going to have to go to a hearing, that is the right time to hire a lawyer. Don't wait until three weeks before your actual hearing date and then decide to start calling around. With the new rules in effect, there's not an attorney out there that will take your case without first expecting a continuance. If you do have to file an appeal for your case and you know you will eventually have a hearing scheduled, then start early looking for experienced representation.
